In compliance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, published in the Official Gazette of the Federation on July 5, 2010 (the "Law"), its Regulations and the Guidelines of the Notice of Privacy, published in the Official Gazette of the Federation on January 17, 2013, extends this Privacy Notice.

 

I. Responsible for the Processing of Personal Data

Carbon Tierra Prieta, SA de CV ("Tierra Prieta"), hereby informs you that your personal data will be treated strictly for the purposes indicated below.

 

II. Personal information

The personal data that will be processed by "Tierra Prieta" consists of personal information of the owner, which may include: your full name, email address, address, telephone numbers, Federal Taxpayer Registry, among other strictly essential for the purposes which are mentioned later.

Personal data will be kept under the strictest confidentiality and may not be given a use other than those mentioned above, unless there is a change in this Privacy Notice, in accordance with the provisions of section XI of this document.

Personal data, once the purpose of their treatment is fulfilled, will be blocked for the sole purpose of determining possible responsibilities in relation to their treatment, until the applicable legal or contractual limitation period. During this period, the personal data may not be processed and, after this period, it will be canceled in the corresponding database and, where appropriate, the physical records will be destroyed.

VII. Means to exercise the rights of access, rectification, cancellation or opposition ("ARCO"), in accordance with the provisions of the Law

The ARCO application must contain and accompany what the Law indicates in its article 29, such as:

  • The name and email address to communicate the response to your request.

  • Official identification or power of attorney, electronically.

  • The clear and precise description of the personal data with respect to which you seek to exercise any of the rights, as well as the right that you wish to exercise.

  • Any other element or document that facilitates the location of personal data, as well as any other document required by current legislation at the time of submitting the request.

“Tierra Prieta” is not obliged to cancel personal data in the case of any of the cases established in the Law, among others the following:

I) That they refer to the parties of a private, social or administrative contract and are necessary for its development and fulfillment;

II) That must be treated by legal provision;

III) That judicial or administrative actions linked to fiscal obligations, the investigation and prosecution of crimes or the updating of administrative sanctions are hindered;

AND IV) That they are necessary to protect the legally protected interests of the holder, to carry out an action based on the public interest, to fulfill an obligation legally acquired by the holder and that are subject to treatment for prevention or for medical diagnosis or management of health services, provided that said treatment is carried out by a health professional subject to a duty of secrecy.

VII. Transfers of personal data that are made
